Medicare Opt Out Affidavit

In order to see Medicare beneficiaries, providers must: 1) Be enrolled as a Medicare provider or 2) Opt out of Medicare to privately contract with Medicare patients. Providers who opt out and privately contract must do so for all services provided to all Medicare beneficiaries; not for some but not others. Medicare providers receive payment directly from Medicare, while those who opt out and privately contract, collect payment directly from the patient. Opt Out providers may also collect from secondary insurance. In order to opt out, providers must file the Medicare Opt Out Affidavit with the Medicare Administrative Contractor for their state. Once approved, opt out status is renewed every two years unless the providers request a change in status.
